EXPIRY OF FINDING
Hot-rolled Carbon Steel Plate and High-strength Low-alloy Plate
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that its finding made on May 17, 1994, in Inquiry No. NQ-93-004, concerning certain hot-rolled carbon steel plate and high-strength low-alloy plate not further manufactured than hot-rolled, heat-treated or not, originating in or exported from Italy, the Republic of Korea, Spain and the Ukraine, is scheduled to expire on May 17, 1999 (Expiry No. LE-98-003). Under the Special Import Measures Act, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire in five years from the date of the last order or finding unless a review has been initiated. A review will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.
Persons or governments requesting or opposing the initiation of a review of the said finding, pursuant to subsection 76(2) of the Special Import Measures Act, should file 10 copies of written public submissions, containing relevant information, opinions and arguments, with the Secretary of the Tribunal not later than September 21, 1998. Persons or governments should endeavour to base their submissions exclusively on public information; however, confidential information relevant to the issues before the Tribunal may be filed if necessary, along with a comprehensive public summary or edited version thereof.
Submissions should address all relevant factors, including:
— the likelihood of the continuation or the resumption of dumped imports if the finding were allowed to expire, with supporting information, including information relating to exporters in Italy, the Republic of Korea, Spain and the Ukraine with regard to their activities in the Canadian market, their domestic market and other markets;
— the likely volumes and price ranges of dumped imports if they were to continue or to resume;
— the domestic industry's performance since the finding, including trends in its production, sales, market share and profits;
— the likelihood of material injury to the domestic industry if the finding were allowed to expire, having regard to the anticipated effects of a resumption of dumped imports on the industry's future performance;
— other developments affecting, or likely to affect, the performance of the domestic industry; and
— any other change in market conditions, domestically or internationally, including changes in the supply and demand for certain hot-rolled carbon steel plate and high-strength low alloy plate, as well as changes in trends and sources of imports into Canada.
Where there are opposing views, each person or government who filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other persons or governments. In these circumstances, the Tribunal will distribute copies of the public submissions to each person or government who filed a submission with the Tribunal. Those persons or governments will have one week to respond in writing to the submissions. If confidential submissions have been filed, the Secretary will notify persons or governments on how they may access these submissions through qualified counsel.
The purpose of a review is to determine whether an order or finding should be continued, with or without amendment, or rescinded. If the Tribunal decides that a review is not warranted, an order, with reasons, will be issued. An order or finding will expire unless a review is initiated before its expiry date.
If the Tribunal decides to initiate a review, it will issue a notice of review with all relevant information regarding the proceeding. The Tribunal will publish the notice in the Canada Gazette and send it to all persons or governments known to the Tribunal as having an interest in the review, who will then have an opportunity to participate in the review.

REVIEW OF TARIFF CLASSIFICATION
Butteroil Blends
Reference
The Canadian International Trade Tribunal (the Tribunal) is undertaking a review of the tariff classification of butteroil blends. The reference was received by the Tribunal on August 11, 1998, from the Deputy Minister of National Revenue (Reference No. AP-98-055).
Pursuant to section 70 of the Customs Act, the Tribunal is to render an opinion with respect to:
a) the tariff classification of butteroil blends comprising less than 50 percent butteroil and more than 50 percent sugar (sucrose); and
b) the tariff classification of blends of butteroil and glucose and blends of butteroil and processing solids, containing less than 50 percent by weight of dairy content.
Letters have been sent to parties with a known interest in the reference providing the notice and the schedule for this reference. The schedule specifies the date for the filing of notices of appearance, the date for the filing of briefs by parties in favour of a change in the tariff classification of the goods in issue, the date for the filing of briefs by those opposed to a change in the tariff classification of the goods in issue and the dates for filing expert witness reports and replies thereto.
Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a public summary of the information designated as confidential or a statement and explanation of any refusal to provide a summary. Information designated as confidential and submitted pursuant to section 46 of the Canadian International Trade Tribunal Act should be clearly marked "Confidential" or "Confidentiel " and filed separately with the Secretary.
Section 45 of the Canadian International Trade Tribunal Act provides that information designated as confidential will be kept confidential and can only be accessed by independent counsel, that is, any person that is not a director, servant or employee of a party. Independent counsel must sign an undertaking stipulating that the confidential information shall be used exclusively for duties performed in respect of the subject reference and that no confidential information will be divulged to any other person, including counsel's clients.
Public Hearing
A public hearing relating to this reference will be held in the Tribunal Hearing Room, 18th Floor, Standard Life Centre, 333 Laurier Avenue W, Ottawa, Ontario, commencing on the January 25, 1999, at 9:30 a.m., to hear evidence and representations by parties.
Each interested person or government wishing to participate at the hearing as a party must file a notice of appearance with the Secretary on or before September 18, 1998. Each counsel who intends to represent a party at the hearing must file a notice of appearance as well as a declaration and undertaking with the Secretary on or before September 18, 1998.
To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested person or government and each counsel filing a notice of appearance must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using English or French or both languages at the hearing.
The Canadian International Trade Tribunal Rules govern these proceedings.

Transitional Digital Radio Undertakings
The Commission hereby announces that it has received applications for licences to carry on transitional Digital Radio Undertakings associated with existing AM and FM stations. The following broadcasters plan to build Digital Audio Broadcasting (DAB) facilities at the Mount Royal Tower to simulcast their current programming services, and up to 14 hours per week of new programming, using the EUREKA-147 DAB system in the frequency band 1452 MHz-1492 MHz (L-Band). The purpose of the broadcasts is to introduce the public to this new radio service, as well as to refine coverage and market issues related to this new technology. The Commission intends to require transitional Digital Radio Undertakings to adhere, by condition of licence, to Parts 1 and 1.1 of the Radio Regulations, 1986.

Canadian Television Policy Review — Revisions to Public Hearing Schedule
1. On May 6, 1998, the Commission issued Public Notice CRTC 1998-44 to announce a review of its Canadian television policy. In that notice, the Commission stated that it would hold an oral public hearing commencing on Wednesday, September 23, 1998, and ending no later than Friday, October 2, 1998.
2. The Commission now considers it necessary to allocate additional time to complete the oral public hearing. Accordingly, it has made provision for the oral public hearing to end on Friday, October 9, 1998, i.e. one week later than the date originally announced.
3. The Commission wishes to advise hearing participants and other interested parties that the hearing's panel will not sit at the following times:
— the morning of Monday, September 28 (the hearing will resume at 1 p.m. on that date unless otherwise announced at the hearing);
— all day on Wednesday, September 30; and
— all day on Tuesday, October 6.
4. Further, and unless otherwise announced at the hearing, the panel does not expect to sit on Saturdays.
5. Given the additional time hereby allotted to conduct the oral public hearing, the Commission extends the deadline for the submission of final written comments to Monday, November 9, 1998.
6. The Commission reminds interested parties to monitor the hearing for information concerning any further procedural directions.
