CANADIAN ENVIRONMENTAL PROTECTION ACT

Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-03184 is approved.

1. Permittee: Department of Public Works and Government Services, Vancouver, British Columbia.

2. Type of Permit: To dump or load dredged material.

3. Term of Permit: Permit is valid from August 11, 1998, to August 10, 1999.

4. Loading Site(s): Pacific Biological Station, Nanaimo, British Columbia, at approximately 49°18.70′ N, 123°08.00′ W.

5. Dump Site(s): Five Finger Disposal Site, 49°15.20′ N, 123°54.60′ W, at a depth of not less than 280 m.

The following position-fixing procedures must be followed to ensure disposal at the designated dump site:

(i) The vessel must call the Vancouver Vessel Traffic Management (VTM) Centre on departure and inform VTM that it is heading for a disposal site,

(ii) Upon arrival at the disposal site, and prior to dumping, the vessel must again call VTM to confirm its position. Dumping can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, VTM will direct it to the site and advise that dumping can proceed, and

(iii) The vessel must inform VTM when dumping has been completed prior to leaving the disposal site.

6. Route to Dump Site(s): Direct.

7. Method of Loading and Dumping: Loading by clamshell dredge with disposal by bottom dump scow, or by end dumping.

8. Rate of Dumping: As required by normal operations.

9. Total Quantity to be Dumped: Not to exceed 1 000 m3.

10. Material to be Dumped: (1) Dredged material and other approved materials typical of the loading site; and (2) Broken concrete slabs and non-usable concrete rubble.

11. Requirements and Restrictions: The Permittee must notify the permit issuing office in writing and receive written approval for each loading site prior to any loading or dumping. The written notification must include the following information:

(i) the co-ordinates of the proposed loading site,

(ii) a site map showing the proposed loading site relative to known landmarks or streets,

(iii) a figure showing the legal water lots impacted by the proposed dredging/loading activities, giving the spatial delineations of the proposed dredge site within these water lots;

(iv) all analytical data available for the proposed loading site,

(v) the nature and quantity of the material to be loaded and dumped,

(vi) proposed dates on which the loading and dumping will take place, and

(vii) a site history for the proposed loading site.

Additional sampling or analytical requirements may be specified by the permit issuing office.

The Permittee must ensure that all contractors involved in the loading or dumping activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in ocean disposal activities. A copy of the written approval for the appropriate loading site must be displayed with copies of the permit posted at the loading sites.

Contact must be made with the Canadian Coast Guard regarding the issuance of a “Notice of Shipping”. The Permittee should contact the District Manager, Canadian Coast Guard, Vessel Traffic Services, Kapilano 100 Building, Room 1205, 100 Park Royal S, West Vancouver, British Columbia V7T 1A2, (604) 666-8453 (Facsimile).

Any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act shall be permitted to mount an electronic tracking device on any vessel that is engaged in the ocean disposal activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an inspector or by a person with the written consent of an inspector.

The Permittee must submit to the Regional Director, Environmental Protection, Pacific and Yukon Region, within 10 days of the end of each month, the quantity of material disposed of from each excavation site pursuant to the permit.

The Permittee must submit to the Regional Director, Environmental Protection, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of from each site, and the dates on which the activity occurred.

9. Requirements and Restrictions:

9.1. A Scuttling Plan designed to ensure accurate positioning of the vessel at the dump site and to address navigational concerns shall be submitted to Mr. Adrian MacDonald, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 4th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, at least seven days prior to towing the vessel to the dump site. The plan shall also identify contingency measures to be employed should low water navigational clearance at the disposal site not exceed 4.8 m. The plan must be approved by Environment Canada prior to the towing of the vessel to the dump site. Scuttling and follow-up measures shall be conducted in accordance with the requirements of the plan.

9.2. The Permittee shall submit a written report to Mr. Adrian MacDonald, identified in paragraph 9.1, at least one week prior to towing the vessel to the dump site. This report must provide the results of an inspection by an individual qualified to judge the seaworthiness of the vessel. (“Qualified individual” means anyone who is qualified/certified as a Master Mariner, Chief Marine Engineer or Naval Architect and holds the Certificate of Competency of the Department of Transport.)

9.3. It is required that the Permittee notify in writing Mr. Adrian MacDonald, identified in paragraph 9.1, at (902) 426-3897 (Facsimile), adrian.macdonald@ec.gc.ca (Electronic mail), at least 48 hours prior to towing the vessel to the dump site.

9.4. A written report shall be submitted to the Canadian Hydrographic Service, Department of Fisheries and Oceans, within two weeks of the completion of the disposal operation. This report shall contain the following information: the exact latitude and longitude of the disposal site, a description of how the position was determined and its estimated accuracy, the orientation of the vessel, and a measurement of the depth of water over the vessel at low tide.

9.5. A written report shall be submitted to Mr. Adrian MacDonald, identified in paragraph 9.1, within 30 days of the completion of the work. This report shall contain the following information: the date of the disposal operation, a copy of the report submitted to the Canadian Hydrographic Service as per the requirement of section 9.4 of this permit, and a video of the vessel following scuttling.

9.6. It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act to any place, ship, aircraft, platform or anthropogenic structure directly related to the ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

9.7. The Permittee shall notify in writing Mr. Peter Winchester, Department of Fisheries and Oceans, 215 Main Street, Yarmouth, Nova Scotia B5A 1C6, (902) 742-6893 (Facsimile), at least one week prior to towing the vessel to the dump site.

9.8. The Permittee shall ensure that all toxic and hazardous materials, including fuels, hydraulic fluids, lubricating oils and other petroleum-based products, and asbestos are removed from the vessel to the satisfaction of an inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act prior to towing the vessel to the dump site.

9.9. The Permittee shall ensure that all unsecured objects are removed from the vessel to the satisfaction of an inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act prior to towing the vessel to the dump site.

9.10. Any floating material resulting from the disposal of the vessel shall be collected by the Permittee and disposed of at an approved solid waste disposal facility.

9.11. The Permittee shall be responsible for the clean-up of any observed oil at the dump site.

9.12. Any observed oil shall be reported immediately to the Canadian Coast Guard by calling 1-800-565-1633.

9.13. A copy of this permit shall be available on-site at the time of the scuttling.

9.14. The ocean dumping referred to under this permit shall not be carried out without written authorization from the Permittee.

2. Type of Permit: To dump or load fish and shrimp offal.

3. Term of Permit: Permit is valid from August 3, 1998, to August 2, 1999.

4. Loading Site(s): 48°30.20′ N, 53°04.90′ W, Port Union, Newfoundland.

5. Dump Site(s): 49°29.00′ N, 52°56.00′ W, at an approximate depth of 130 m.

6. Route to Dump Site(s): Most direct navigational route from the loading site to the dump site.

7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transport to the approved dump site.

8. Method of Dumping: Direct release.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 7 000 tonnes.

11. Material to be Dumped: Fish and shrimp offal.

12. Requirements and Restrictions: It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Branch, Department of the Environment, 6 Bruce Street, Mount Pearl, Newfoundland A1N 4T3, (709) 772-5097 (Facsimile), at least 48 hours prior to the start of the first dumping operation to be conducted under this permit.

A written report shall be submitted to Mr. Rick Wadman, Environmental Protection Branch, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

The dump site must be marked and all dumping must take place within 100 m of the dump site marker.

The loading and transport of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

The fish offal and shrimp offal must be covered by netting or other material to prevent access by gulls.

This permit must be displayed in an area of the plant accessible to the public.

Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.

Fish and shrimp offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

RADIOCOMMUNICATION ACT

Notice No. DGTP-013-98 — Spectrum Policy and Licensing Provisions for Fixed Wireless Access Systems in Rural Areas in the Frequency Range 3400–3700 MHz

The purpose of this notice is to announce the release of a policy paper under the above-mentioned title.

In August 1997, Industry Canada released a spectrum policy consultation paper, under Canada Gazette Notice No. DGTP-006-97, which addressed several new opportunities for usage of the radio spectrum in the 1–20 GHz frequency range including the introduction of fixed wireless access systems in the frequency range 3400–3700 MHz.

The Department has received significant interest from telecommunication service providers and equipment manufacturers to open new spectrum at 3.4 GHz for fixed wireless access systems. Wireless multipoint systems could offer an economical means to provide telephony and data services to business and residential customers. In particular, these systems could provide a promising technology in upgrading rural communications.

Based on the public interest shown, the Department agrees that there is a need to make spectrum available for wireless communications to advance telecommunications in rural areas. The spectrum policy provides for the licensing of radio systems in this band on a first-come, first-served basis in rural areas.

Comments on Spectrum Licensing Fees

Comments are invited on the proposed spectrum licensing fees for fixed wireless access systems (refer to section 3.1.4 in the policy paper). The comments which will be made public, should be submitted on or before October 13, 1998, to the office of the Director General, Radiocommunication and Broadcasting Regulatory Branch, Industry Canada, Jean Edmonds Building, 300 Slater Street, Ottawa, Ontario K1A 0C8.
