Notice is hereby given that, pursuant to the provisions of Part VI of the Canadian Environmental Protection Act, Permit No. 4543-2-03205 is approved.

1. Permittee: Fraser River Harbour Commission, New Westminster, British Columbia.

2. Type of Permit: To dump or load dredged material.

3. Term of Permit: Permit is valid from July 12, 1998, to June 30, 1999.

4. Loading Site(s): Various approved sites in the Fraser River estuary at approximately 49°12.00' N, 123°08.00' W.

5. Dump Site(s):

(a) Point Grey Disposal Site, 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m;

(b) Sand Heads Disposal Site, 49°06.00' N, 123°19.50' W, at a depth of not less than 70 m;

(c) PWC Spoil Area 2, 49°07.80' N, 123°14.60' W, at a depth of not less than 18 m;

(d) PWC Spoil Area 3, 49°06.40' N, 123°07.90' W, at a depth of not less than 13 m;

(e) PWC Spoil Area 4, 49°07.80' N, 123°04.00' W, at a depth of not less than 14 m;

(f) PWC Spoil Area 5, 49°09.40' N, 122°59.70' W, at a depth of not less than 10 m;

(g) PWC Spoil Area 8, 49°15.70' N, 123°17.30' W, at a depth of not less than 18 m; and

(h) PWC Spoil Area 8A, 49°16.40' N, 123°16.70' W, at a depth of not less than 5 m.

The following position-fixing procedures must be followed to ensure disposal at the designated dump site:

(i) The vessel must call the Vancouver Vessel Traffic Management (VTM) Centre on departure and inform VTM that it is heading for a dump site.

(ii) Upon arrival at the disposal site, and prior to dumping, the vessel must again call VTM to confirm its position. Dumping can proceed if the vessel is on the dump site. If the vessel is not within the dump site boundaries, VTM will direct it to the site and advise that dumping can proceed.

(iii) The vessel will inform VTM when dumping has been completed, prior to leaving the dump site.

6. Route to Dump Site(s): Direct.

7. Method of Loading and Dumping: Clamshell dredge and scow, cutter suction and hopper dredges and bed-levelling equipment with disposal by bottom scows or end dumping.

8. Rate of Dumping: As required by normal operations.

9. Total Quantity to be Dumped: Not to exceed 50 000 m3.

10. Material to be Dumped: Dredged material typical of the approved loading site except logs and usable wood.

11. Requirements and Restrictions: Additional sampling or analytical requirements may be specified by the permit issuing office.

The Permittee must notify the permit issuing office before commencement of the project as to the dates on which the loading and ocean dumping will occur.

The Permittee must ensure that all contractors involved in the loading or dumping activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be displayed at the loading site and must be carried on all towing vessels and loading platforms or equipment involved in ocean dumping activities.

Contact must be made with the Canadian Coast Guard regarding the issuance of a "Notice of Shipping". The Permittee should contact the District Manager, Canadian Coast Guard, Vessel Traffic Services, Kapilano 100 Building, Room 1205, 100 Park Royal S, West Vancouver, British Columbia V7T 1A2, (604) 666-8453 (Facsimile).

The Permittee must submit to the Regional Director, Environmental Protection, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of from each site and the dates on which the activity occurred.

2. Type of Permit: To dump or load fish offal.

3. Term of Permit: Permit is valid from July 23, 1998, to July 22, 1999.

4. Loading Site(s): La Tabatière Harbour, 50°50.25' N, 58°58.45' W (NAD 27).

5. Dump Site(s): Within a 200 m radius of 50°50.90' N, 58°57.70' W (NAD 27).

6. Route to Dump Site(s): Direct navigational route from the loading site to the dump site.

7. Equipment: Towed scow, barge or boat.

8. Method of Dumping: Direct discharge of the wastes into the sea within the perimeter indicated in condition 5.

9. Rate of Dumping: As required by normal operations.

10. Total Quantity to be Dumped: Not to exceed 500 tonnes.

11. Material to be Dumped: Wastes from fish, shellfish, crab and lobster processing.

12. Requirements and Restrictions: It is required that the Permittee report, in writing, to the Regional Director, Environmental Protection, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, at least 48 hours prior to the start of the first dumping operation to be conducted under this permit. A written report shall be submitted to the Regional Director, within 30 days of the expiry of the permit. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the dumping and loading activities occurred.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

A copy of this permit must, at all times, be kept aboard any vessel involved in the dumping operations.

The Permittee must complete the Registry of Ocean Dumping Operations as provided by the Department of the Environment. This registry must, at all times, be kept aboard any vessel involved in the dumping operations and be accessible to inspectors designated under the Canadian Environmental Protection Act.

The loading and ocean dumping referred to under this permit shall not be carried out without written authorization from the Permittee.

The barge or containers used to transport the wastes must be covered in a manner to prevent access by gulls and other sea-birds.

The loading must be completed in a manner that ensures no material contaminates the marine environment, including the harbour and adjacent beaches. The Permittee must also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

A written report shall be submitted to Mr. Rick Wadman, Environmental Protection Branch, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

The dump site must be marked and all dumping must take place within 100 m of the dump site marker.

The loading and transit of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

The fish offal and crab offal must be covered by netting or other material to prevent access by gulls.

This permit must be displayed in an area of the plant accessible to the public.

Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.

Fish and crab offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

Requirements and Restrictions: It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Branch, Department of the Environment, 6 Bruce Street, Mount Pearl, Newfoundland A1N 4T3, (709) 772-5097 (Facsimile), at least 48 hours prior to the start of the first dumping operation to be conducted under this permit.

A written report shall be submitted to Mr. Rick Wadman, Environmental Protection Branch, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and dumping activities occurred.

It is required that the Permittee admit any inspector designated pursuant to subsection 99(1) of the Canadian Environmental Protection Act, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

The dump site must be marked and all dumping must take place within 100 m of the dump site marker.

The loading and transit of waste material to the dump site must be conducted in such a manner that no material enters the marine environment. Waste material spilled at any place other than the permitted dump site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

The fish offal must be covered by netting or other material to prevent access by gulls.

This permit must be displayed in an area of the plant accessible to the public.

Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

The loading or ocean dumping conducted under this permit shall not be carried out without written authorization from the Permittee.

Fish offal loaded for the purpose of ocean dumping may not be held aboard any vessel for more than 96 hours without the written consent of an inspector designated under the Canadian Environmental Protection Act.

Proposed User Fees for Federal Corporations Data Online and Canada Corporations Bulletin

This notice is to invite the public to comment on proposed user fees to be established under sections 18 and 19 of the Department of Industry Act for the Federal Corporations Data Online and the Canada Corporations Bulletin.

Description of Information Services

Federal Corporations Data Online ("Database")

The Database contains information about federal companies incorporated under the Canada Business Corporations Act (CBCA), the Canada Corporations Act (not-for-profit corporations), the Boards of Trade Act, the Canada Cooperative Associations Act and several other related corporate laws administered by Industry Canada's Corporations Directorate ("ICCD"). Access to the Database is now and will continue to be available through several means:

— online access through Industry Canada's Web site, Strategis;

— requests made to ICCD by telephone, in writing or in person;

— through third party providers who buy the Database and resell or use the data to provide service to their customers; and

— through microfiche subscriptions of the Database.

Currently no fees are charged for online access to the Database or for requests by phone, in writing or in person. ICCD charges third party providers $1,000 per year, on a contractual basis, or a royalty fee on their resale of the data which includes monthly updates of the Database. Only two businesses buy the Database. The annual subscription rate for the microfiche is currently $300, which includes monthly updates. (The fee has not been changed in over 10 years.) There are 98 subscribers to this service but only 45 of these subscribers pay the subscription fee as fees are not charged to other government departments and libraries.

Canada Corporations Bulletin ("Bulletin")

The Bulletin is a monthly online publication, available through Strategis, containing information on new federal incorporations and changes to existing federal corporations, as well as information related to statutory filings, proposed regulations, and notices to clients. The Director is required under the CBCA to publish certain documents such as insider reports and exemption orders in the Bulletin. ICCD offers the Bulletin at an annual subscription rate of $225. There are 31 subscribers to this service.

Proposed User Fees

The proposed user fees to be charged under the Department of Industry Act are set out below. The fee for the Bulletin will remain unchanged. The aim of the proposed new and amended fees is to recover some of the costs of providing the information at a price that is reasonable in comparison with similar types of information services offered by provincial corporate administrators.

The fees for online access to the Database will be payable by secured online transactions using VISA, Mastercard and deposit accounts. Debit card payments may be introduced in the future. Telephone requests for information are planned to be provided through the Bell Advantage 900 service with the fee based on a per minute basis (one search normally takes one minute).

Considerations

It is the federal government's policy to implement user fees for services or products that provide identifiable recipients with direct benefits beyond those received by the general public. The aim of the policy is to promote efficient allocation of resources, to promote an equitable approach to financing government programs and to earn a fair return for the Canadian public for access to, or exploitation of, publicly owned or controlled resources.

Requests for information on federal corporations come from a variety of sources such as individuals and intermediaries. The primary users of this information are the intermediaries such as law firms and search houses who want fast and easy access to records managed by ICCD. Without these services, users would have to obtain the information by requesting copies of the documents filed with ICCD which is a more lengthy process. These users derive a private benefit from fast and easy access to information since they use the information to enhance their service to fee-paying clients. As for individuals, they are deriving a benefit from obtaining the information quickly; as mentioned above, they can order copies of the documents instead of using the Federal Corporations Data Online.

The cost to Government to provide the Database and the Bulletin exceeds $600,000 per year. Half of the cost relates to collecting and maintaining the information and the other half relates to its distribution. The projected revenue of the proposed schedule of fees does not equal nor exceed the cost to Government.

General

Notice No. DGRB-004-98 — Guidelines for Compliance with the Radio Authorization Condition of Licence Relating to Research and Development

The purpose of this notice is to invite public comments on the document entitled Guidelines for Compliance with the Radio Authorization Condition of Licence relating to R&D.

The research and development (R&D) licensing commitments were established for cellular licensees in 1985 and have since been applied to Personal Communications Services (PCS), Local Multipoint Communications Services (LMCS), Mobile Satellite Services (MSS) and Direct Broadcast Satellite Services (DBS) licence holders. On May 21, 1998, Industry Canada announced changes, as approved by John Manley, Minister of Industry, to the administration procedures for R&D conditions of licence. The changes are being made to encourage a broader range of partnerships and alliances through which R&D investments can be made. This document clarifies the types of eligible R&D investments for the purposes of the licence conditions and outlines the reporting requirements.

Notice is hereby given that a petition from Clearnet Communications Inc., Microcell Telecommunications Inc., and Rogers Cantel Inc. has been received by the Governor in Council under section 12 of the Telecommunications Act in regard to one decision and one order issued by the Canadian Radio-television and Telecommunications Commission (CRTC): (1) Telecom Decision CRTC 98-4: Joint Marketing and Bundling, issued on March 24, 1998, and (2) Telecom Order 98-499 issued on May 25, 1998, which granted approval to Bell Canada's SimplyOne Service. The request is based on several reasons included in the petition.

Telecom Decision CRTC 98-4 sets out, among other things, the removal of restrictions on joint marketing of wireline and wireless services and sets the conditions for the Stentor companies for bundling of tariffed telecommunications services with the services of an affiliated or non-affiliated company or with non-telecommunications services. Telecom Order 98-499 approved the application by Bell Canada for the addition of General Tariff Item 2210, Bell SimplyOne Service, a bundled wireline and wireless service.
