COMMENCEMENT OF PUBLIC INTEREST INVESTIGATION
Prepared Baby Food
On April 29, 1998, the Canadian International Trade Tribunal (the Tribunal), under subsection 43(1) of the Special Import Measures Act (SIMA), found that the dumping in Canada of prepared baby foods, containing finely homogenized vegetables, fruit and/or meat which may include some visible pieces of not more than 6.5 mm in size, and strained juice, put up for retail sale as food and beverages for infants of ages 4 to 18 months, in containers of a net volume not exceeding 250 ml, excluding organic baby food and frozen baby food preparations, originating in or exported from the United States of America, had caused material injury to the domestic industry (Public Interest Investigation No. PB-98-001).
By letter dated January 30, 1998, the Tribunal advised counsel and parties to the certain prepared baby food inquiry that, in the event of an injury finding, it would consider the question of public interest in accordance with its Guidelines for Public Interest Investigations (February 1995). In view of its finding of material injury dated April 29, 1998, the Tribunal established a process for the filing of representations on the question of public interest by persons who, during the inquiry under section 42 of SIMA, had notified the Tribunal of their wish to do so.
Having considered all the representations received on the question of public interest, the Tribunal is of the view that a number of factors exist which, when considered together, constitute exceptional circumstances that demonstrate a public interest concern worthy of further investigation. In reaching this decision, the Tribunal considered, in particular, the nature and structure of the Canadian industry and market, the question of the commercial availability of certain prepared baby food from non-subject sources and the effect of anti-dumping duties on low-income families.
Consequently, the Tribunal has initiated a public interest investigation under section 45 of SIMA. Section 45 provides that, where the Tribunal is of the opinion that the imposition of anti-dumping duties, or the imposition of such duties in the full amount, would not or might not be in the public interest, it shall report to the Minister of Finance that it is of that opinion and provide him with a statement of the facts and reasons that caused it to be of that opinion. If, at the conclusion of the investigation, the Tribunal is of the opinion that there is not a public interest concern that warrants the reduction or elimination of the anti-dumping duties, it will issue a brief report with reasons for that opinion.
Public Hearing
As presently scheduled, a public hearing relating to this investigation will be held in the Tribunal Hearing Room, Standard Life Centre, 18th Floor, 333 Laurier Avenue W, Ottawa, Ontario, commencing September 14, 1998, at 9:30 a.m.
Interested parties and counsel who filed a notice of appearance in the inquiry under section 42 of SIMA are considered parties to the public interest investigation and are not required to file another notice of appearance with the Secretary. Each person or government wishing to participate in the public interest investigation as a party and that was not a party to the inquiry under section 42 must file a notice of appearance with the Secretary on or before July 30, 1998. Each counsel who intends to represent a party in the public interest investigation and who did not represent that party at the inquiry under section 42 of SIMA must file a notice of appearance as well as a declaration and undertaking with the Secretary on or before July 30, 1998.
To allow the Tribunal to determine whether simultaneous interpretation will be required for the hearing, each interested party and each counsel filing a notice of appearance must advise the Secretary, at the same time that they file the notice, whether they and their witnesses will be using French or English or both languages at the hearing.
The Canadian International Trade Tribunal Rules govern these proceedings.
Along with the notice of commencement of this investigation, the Secretary has sent a letter to parties in the inquiry under section 42 of SIMA as well as to persons who had notified the Tribunal during that inquiry of their intention to make public interest representations. The letter provides more information and details on the procedures and the schedule for the public interest investigation. It specifies, among other things, the date for filing replies to Tribunal questionnaires, the date on which information on record will be made available by the Tribunal to interested parties and counsel that have filed a notice of appearance, and the date for the filing of submissions by interested parties.
Under section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

REVIEW OF ORDER
Paint Brushes and Heads
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76(2) of the Special Import Measures Act, review (Review No. RR-98-002) its order made on January 18, 1994, in Review No. RR-93-003, continuing, without amendment, its review finding made on January 19, 1989, in Review No. R-13-88, continuing, with amendment, the order of the Anti-dumping Tribunal made on September 28, 1984, in Review No. R-7-84, and continuing, without amendment, the finding of the Anti-dumping Tribunal made on June 20, 1984, in Inquiry No. ADT-6-84, concerning paint brushes using natural hog bristle as the filament material, and the components thereof known as "heads," originating in or exported from the People's Republic of China.
Notice of Expiry No. LE-98-001 informed interested persons and governments of the impending expiry of the order. On the basis of available information, including representations requesting or opposing the initiation of a review and responses to these representations received by the Tribunal in reply to the notice, the Tribunal is of the opinion that a review of the order is warranted.
Letters have been sent to parties with a known interest in the review providing the schedule for the review. The schedule specifies, among other things, the date for the filing of replies to Tribunal questionnaires, the date on which information on the record will be made available by the Tribunal to interested parties and counsel that have filed notices of appearance and the dates for the filing of submissions by interested parties.
