Description

The Airport Vehicle Parking Charges Regulations prescribe the fees to be charged the general public for vehicle parking at certain Transport Canada airports. The parking fees are based on those fees charged at similar parking facilities in the area served by the airport. The Regulations include the Goods and Services Tax (GST) and changes to some fees currently in effect. The proposed changes will bring existing rates into line with those for similar parking facilities and will moderate demand for vehicle parking at certain facilities.

The application section of these Regulations will make clear that they apply to parking services, including those related to members of Parliament, Supreme Court justices and diplomatic agents or consular officers, provided only at airports operated by the Minister of Transport.

Due to the Ontario Retail Sales Tax Act and a reciprocal taxation arrangement between Canada and the Province of Ontario, Transport Canada must collect and remit to the province the 8 percent retail sales tax (RST) for parking services in Ontario. As a result of recent changes to the current retail sales taxes in Nova Scotia, New Brunswick, and Newfoundland and Labrador, the federal Goods and Services Tax (GST) in those provinces has been replaced by a single, harmonized value-added tax, the Harmonized Sales Tax (HST) at a rate of 15 percent. The parking charges in the schedule now include the RST for Ontario airports and the HST for the above noted provinces for Atlantic airports.

Signs containing the amended parking rates and the effective dates of the new rates will be placed in a prominent location at the airports affected.

These Regulations are to be effective upon registration by the Clerk of the Privy Council.

Alternatives

As it is a matter of policy to shift the burden from general taxpayers to transport users, there are no alternatives to prescribing fees. The only flexibility is in the determination of the appropriate level of fees.

Benefits and Costs

These amendments will result in an estimated gross revenue increase of approximately $570,000 per annum for the applicable airports. The estimated increase in total revenue ranges from 10 to 120 percent at the applicable airports.

From this amount, approximately $190,000 will be applied to the federal Goods and Services Tax (GST), various provincial Retail Sales Taxes (RST) and the new Harmonized Sales Tax (HST) in the Atlantic provinces. Approximately $50,000 is required by the sites for operating and maintaining the parking facilities. The remaining revenue of approximately $380,000 will contribute to the overall cost of airport operations, thereby reducing reliance on the public purse.

The Government will incur costs with respect to these Regulations for signage, newspaper advertisements, necessary changes to equipment related to parking facilities and resources required to establish the changes in the fees.

These Regulations will have a minimal impact on the Canadian public. In the past, there have been very few complaints from the public concerning the parking fees at the airports.

Consultation

The travelling public is the major user of vehicle parking facilities at airports. It is not practical to consult with all potential users of parking facilities at those Transport Canada-operated airports for which a fee increase is being proposed, as the majority of the users do not belong to one identifiable group.

Compliance and Enforcement

Owners of vehicles which have remained in a parking space beyond the maximum period stipulated on the parking meter for that space may be issued parking violations by the body responsible for security at that airport.

To ensure payment of fees at other parking facilities, vehicles must exit the facility by an attended toll booth. Vehicles are detained until the necessary fees have been paid.

Notice is hereby given that the Minister of Transport proposes, pursuant to subsection 4.4(2) (see footnote a) of the Aeronautics Act, and section 2 of the Ministerial Regulations Authorization Order, made by Order in Council P.C. 1986-1348 of June 5, 1986 (see footnote b) to make the annexed Regulations Amending the Airport Vehicle Parking Charges Regulations.

Interested persons may make representations concerning the proposed Regulations to the Minister of Transport within 30 days after the date of publication of this notice. All such representations must cite the Canada Gazette, Part I, and the date of publication of this notice, and be sent to A.
